About Harold E. Kaplan, M.H.A., J.D.

Harold E. Kaplan represents health care providers for their full range of corporate, employment, reimbursement and related legal needs, including practice mergers, purchases and sales, managed care contracting, provider practice consulting and self-referral issues and fraud and abuse matters.  He is a Florida Board Certified Health Law Attorney and Past Chair of the Florida Bar's Health Law Section (2006-2007) and Past Chair of the Florida Bar's Health Law Section Board Certification Committee.  

Mr. Kaplan is also an arbitrator and neutral dispute resolver credentialed by the American Health Lawyers Association and also by the American Arbitration Association and a Civil Court Mediator Certified by the Florida Supreme Court.  He is AV rated by Martindale-Hubbell® and listed in its 2010 edition of preeminent attorneys.  He was voted a Florida Super Lawyer in 2007 through 2010.  He is a member of the American Health Lawyers Association and the American Bar Association's Health Law Section and a member of the ABA's and Florida Bar's Sections on Alternative Dispute Resolution.

Mr. Kaplan is a graduate of Pace University, School of Law (J.D. 1983), Pace University, Lubin School of Business, (B.B.A. 1972), University of Ottawa, Graduate School of Health Administration (M.H.A. 1974), and the Nova University Circuit Civil Dispute Resolution program.  He has also attended the American Bar Association's Alternative Dispute Resolution Section's three day arbitrator's training institute. 

Mr. Kaplan was formerly the Health Law Partner at a major Florida Law Firm and he previously practiced health law in New York City representing numerous teaching hospitals and individual and group providers.  His hospital administration experience encompasses not-for-profit teaching hospitals as well as investor-owned facilities.  Mr. Kaplan has served in senior administrative positions and as C.E.O. for Florida and New York hospitals.

He has also served as a member of the Executive Council and as its Secretary and Treasurer.  He has been Chairperson of various divisions as well as Program Chair for numerous educational programs.  Mr. Kaplan frequently speaks on health law subjects and has presented for the American Health Lawyers Association, the Florida Bar, the Florida Hospital Association, the Broward County Medical Association, and for hospital Medical Staffs.  Among his recent published articles are: "Physicians As DME Suppliers Under Stark" and "Are Referring Physicians Protectable Business Interests?" both published in The Florida Bar, Health Law Section Newsletter, in 2008.  He recently presented at the American Health Lawyers Association, February 2009, Physicians and Physician Organizations Law Institute, Phoenix, Arizona on "Clinical Management Agreements: Medical Practice and Management Company Perspectives".

He is listed in the Sixth Edition of Marquis' Who's Who in American Law and in the Fourth Edition of Who's Who of Emerging Leaders in America.
